Biometric Security and Estate Access: A New Legal Gray Area

Fingerprints and face scans have made devices faster to unlock — and, without anyone quite planning for it, harder for a family to access after death. A password can be written down and passed along. A fingerprint can’t.

Where this creates real problems

• Phones and laptops secured only by biometrics, with no backup PIN documented anywhere
• Banking and authentication apps that require a live biometric scan to unlock, with no fallback method set up
• Two-factor authentication tied to a specific device’s biometric unlock, creating a chain where losing access to one device locks out several accounts at once

Most devices and apps do allow a backup PIN or password alongside biometric login — but because biometrics are so convenient day-to-day, that backup often never gets set up, or gets forgotten entirely.

What families can do now

• Confirm every device has a backup PIN or password set, not just biometric unlock
• Document that backup method the same secure way you’d document any other password — in a vault, not a sticky note
• Understand that even with a documented PIN, some platforms may still require additional identity verification, which is where a digital executor’s documented legal authority matters

This is a newer, less-settled area of estate planning — the law is still catching up to how much of daily life now depends on a fingerprint or a face. Building in a backup method today is the simplest way to avoid becoming a test case for it later.
